This Terms and Conditions of Use (Terms) were last modified on 10/11/2015.

The Creatopia Portal www.creatopia.ae (“The Portal”) is created and operating by Dubai Culture and Arts Authority (The Authority) a Dubai government’s organization, the below conditions governs your profile registration and use of The Portal.

Please read these Terms and Conditions of Use carefully before registering a talent profile or use The Portal. 

The Terms are considered to be the legal agreement between you and The Authority which stating conditions that govern making profile and use of The Portal, by accessing and using The Portal, you agree to conditions of this agreement, if you do not agree to the terms of this agreement, you are not allowed to make profile or use The Portal, you have to accept and abide by these terms as stated without any changes from your side.  

1- Definitions:

In this Agreement the following words and expressions shall, unless the context otherwise requires, have the following meanings:

Intellectual Property rights: refers to rights created by mind such as copyright, trademarks, patents, industrial models and digital rights... etc.

Copyright: means the legal protection of an author's work, the author of the content has the exclusive right of publication, distribution, right to make copies, license, of his/her work, the copyrights is a type of intellectual property right and it shall extend but not limited to artistic work, whether printed, audio, video, books, poems, plays, songs, films, websites and other online content .. etc. The content of the author cannot be used or published by anyone else without the prior consent of the author. 

2- Rights / responsibilities: 

Ownership/Usage and Sharing of Content:

The talent retains all rights and ownership for content posted by him/her in his /her profile, The Authority doesn’t own the user’s generated content.  

For all posted work, the talent acknowledges that he/she has the full intellectual property rights of the posted work and hence grants The Authority the right to use/share of the same. 

By creating a profile in The Portal, the Talent grants The Authority the right to use the content of his / her profile for promotional purposes with or without the talent’s prior consent.

The Authority and users of The Portal has the right to share content on social media for promotional purposes with credit to Talent. 

The Authority doesn’t have control over how other users might use the content; the talent has the right to object according to the procedures of issues/disputes set forth in Article (9) of this agreement.  

The Authority will take all measures to protect the security of content of the profile, however, in case of security incidents; The Authority is not responsible for loss, corruption, or damage of content.

The Authority does not endorse any content on The Portal. Some of which may be labeled or categorized incorrectly. 



3- Acceptance of the Terms and Conditions of Use

Your access and registering a talent profile in The Portal is subject to your acceptance of and compliance with these Terms.

These Terms apply to all talents, users, visitors and others who access or use The Portal.

By making a talent profile or using the services in The Portal, you agree to be bound by these Terms and Conditions of Use. If you disagree with any part of the Terms, then you are not permitted to access or use The Portal. 

Once you make a profile in The Portal, you are consenting to our processing of your information now and as amended by us. "Processing,” means, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United Arab Emirates. If you reside outside the United Arab Emirates, your information will be transferred, processed and stored there under United Arab Emirates privacy standards. 



4- Intellectual Property rights:

You agree that The Authority is the owner or the licensee of all intellectual property rights of The Portal, The Portal is protected by copyright laws in the United Arab Emirates and around the globe.

You have no right to copy, distribute, reproduce, sell, lease or assign any content of The Portal. 

You have no right to modify or create derivative works of any aspect of The Portal other than with respect to your own profile.



5- Links to other websites:

The Portal may contain links to third party websites or services that are not owned or controlled by The Authority; The Authority has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that The Authority shall not be responsible or liable, directly or indirectly, for any damages or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services. In case we have links to other websites, in addition, The Authority is not responsible to the content appearing on these websites or services. We advise you to read the terms and conditions and privacy policies of any third party websites or services that you visit. 



6- Privacy Policy:

The Authority respects your privacy and has prepared a detailed Privacy Policy that is incorporated into this Agreement. Please take the time to read our Privacy Policy by clicking here: Privacy Policy. By agreeing to these Terms, you are also accepting the terms of our Privacy Policy.

7- The Portal key functionalities:

Talents in all disciplines will be creating their own profiles in The Portal to showcase their work. 

Profile shall include basic information as well as projects information. 

The Authority will conduct periodical profile inspection on The Portal where the artist is required to update recent activities to demonstrate that he/she has continued his artistic practice.

The Portal will include the following: 

A Gallery of featured work.

Resources section to publish researches, articles, eBooks or any related materials.

Projects section where talents/entities can post projects whether they are in the process of implementation or completed, or can join other available projects.

Events related to Art, Culture & Heritage.

Discussion forums and blogs.

A platform for artists to sell their art work. 



8- Other considerations:

The Authority may block access to certain services in certain countries. 

The talent is responsible to make sure that services offered through The Portal are legal in his/her country. The Authority is not responsible for any dispute as a result. 

Comments posted by The Portal users do not necessarily represent The Authority views. 



9- Procedure in case of issues/disputes:

It is prohibited to post any content on The Portal that violates any international, national, local copyright, patent, trademark or other intellectual property laws or criminal or civil law applicable in the United Arab Emirates or in any other country in the world.

The Authority is not responsible for any content submitted by talents or users of The Portal that infringes another’s proprietary rights.

The talents /user of The Portal should have the right to report any issues / violations observed on Portal through such as content deletion, copy right violation or any other infringement according to the following process: 

Email communication to info@creatopia.ae,

Include description of the problem,

Include links, supporting screen shots,

Include contact information. 

The Authority may investigate and report back to the talent within 10 working days and determine in its sole discretion whether to remove or request the removal of the content. The Authority has no liability or responsibility to talents or users for performance or nonperformance of such activities set forth in this article.

The talents /user of The Portal may send any suggestion regarding The Portal to The Authority via E. mail: info@creatopia.ae.



10- Talent Profile Acceptance Criteria:

Fill out the required information as shown in “Talent Profile Application” on The Portal.

The prospective talent age should be above 21 years of age (should be eligible to get into a contractual agreement), If you are below 21 years of age, you confirm that your parent/ guardian /trustee approval is obtained.

Corporate may register profile in the Portal, provided that valid trade license or decree of incorporation as well as attested NO OBJECTION Letter from the corporate authorizing a person to carry out registration process on behalf of the corporate should be uploaded with registration application. The e- mail used for registration in the portal must be the entity official e-mail and not a personal free e-mail.



All nationalities may make profile in The Portal from in or outside United Arab Emirates. 



11- The Authority will follow the following procedure to accept/reject Talent Profile: 

Applications must be verified through emails by The Authority.

The Authority shall have the right to review the information on the registration application and may approve/reject the same without giving reasons. 

The Authority shall manually filter profile registration application to remove prohibited and/ or immoral content, photos, or any other content/photos considered to be in contradiction to the law or the United Arab Emirates public order.  

The Authority shall manually filter any subsequent posts that may sent by talents before publishing on The Portal and shall remove prohibited and/ or immoral content, photos, or any other content/photos considered to be in contradiction to the law or the United Arab Emirates public order.

The prospective talent will be notified by The Authority if there is an incomplete requirement/s. 

The Authority may reject registration of any profile in The Portal without giving reasons.



12- Content/Account Deletion & Backup:

The Authority has the right to remove all or some of user’s content from The Portal if inappropriate as per Article (14) herein.

The Authority has the right to back up all content posted on The Portal for security reasons. 

The Authority has the right to Create Artists profiles & make them available on the portal artist profiles without their consent. 

The Authority assumes that all activities, posts are done through the account owner and he/she is responsible for any violation of privacy policy. The Talent is responsible to protect log-in credentials to avoid any misuse. The Authority retains the right to block any user in case of service abuse occurred as stated in Article (13) herein.



13- Service Abuse:

The Authority shall block the Talents profiles if the Talent:

Spams other users through messages, comments.

Collects other talents information for the purpose of harm.

Imitate/copy Portal design, services … etc. 

Posting others work without the owner prior consent (own work only should be used by the account owner).

Copy others work for any purpose that violate the talents copy right.

Posting advertisements through the profile unless approved by The Authority.

Did not use his/her own real name in the Portal or impersonate others



14- prohibited contents:

The following contents are prohibited in The Portal:

Content that violates copyright and intellectual property of others, not owned by the account owner. 

Content that is unacceptable for younger audience such as nudity, expletives or graphically violent.

Content that is offensive, display illegal acts, or threatening. 

Content of a political nature.

Content that might cause harm to others computers such as viruses, worms or any malware.

Content that includes advertisements and promotions of entities or individuals to generate revenues.



15- Hiring Procedure:

In case the talent is hired through The Portal, the following procedures should be followed: 

A direct contract / agreement shall be concluded between the Talent and the hiring entity, the Talent should directly arrange with the hiring entity in this respect. The Authority shall not be a part of the said deal. 

The Authority only facilitate the contact between the Talents and hiring entities or art buyer, therefore, The Authority shall not be responsible for any dispute arising between the talent and the said entities as a result of any violations.

Hiring requests/purchase request should be recorded through The Portal activity.



16. Limitation of Liability:

The Authority shall not be liable responsible to any damages whatsoever, direct or indirect loss or damage incurred by any talent or user in connection with The Portal or in connection with the use, inability to use, or results of the use of The Portal, any websites linked to it, and any materials posted on it, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill or any other kind of damages.

17. Termination of Access to The Portal: 

The Authority reserves the right to block any talent or user or terminate them from accessing The Portal for any breach of these Terms and Conditions of Use at any time without prior notice. 

The Authority reserves the right to delete any of talent’s content from The Portal at any time without prior notice.

The Authority is not liable to any talent or user or a third party for any termination of their access to The Portal or deletion of their posted contents. 

The talent/ user agree not to try to use The Portal after the said block/ termination, otherwise the Authority we take the necessary legal action in this regard.

18. Compensation: 

You agree to indemnify The Authority from any claim or loss alleging or resulting from your use or misuse of The Portal, your breach of these Terms and Conditions of Use, your violation of any third party’s proprietary rights, or any disputes between you and one or more talents/users connected to or arising from The Portal in any way.

19. Modifications of the Terms: 

The Authority reserves the right at any time and without prior notice to modify these Terms and Conditions of Use and to impose new or modified conditions on your use of The Portal. Your continued use of the Website constitutes your acceptance of all such additional or modified Terms, if you do not agree to the new terms; you are not allowed to continue using The Portal. 

20. Governing Law and Dispute Resolution 

These Terms and Conditions of Use are governed by the United Arab Emirates and Dubai laws. 

In the event of any disputes between the talent/user and The Authority, the applicable law will be that of United Arab Emirates and Dubai governing laws, and the courts of the Emirate of Dubai shall have the exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions of Use.
